Diagnosis Murder – Documentary on Shaken Baby Syndrome
The Fifth Estate
Diagnosis Murder
Gillian Findlay examines the conventional wisdom around Shaken Baby Syndrome, discovering that those who question it often feel targeted by those who believe passionately in it. And yet new science suggests the so-called syndrome may be a physical impossibility.
“Diagnosis Murder” tells the story of several Canadian parents who say they were wrongfully accused–and the leading-edge medical researchers who believe they’re telling the truth. The stakes are high: Some have gone to jail. All have had their other children taken away from them.
One couple recently had their children returned after a four-year battle. Even though the courts in B.C. cleared Zabeth and Paul Baynes of charges they had shaken their baby, the couple feel they will carry the stigma for life. Another man in Ontario has now had his case put up for judicial review, giving him hope that his name may too be cleared.
Is Shaken Baby Syndrome conclusive evidence of murder? Or is it a scientific hypothesis that has convicted an untold number of parents as killers — when their children actually died from other causes?

The problem isnt that there was a medical misdiagnosis as bad as that is but that there is a consequent miscarriage of justice. For it is not the medical misdiagnosis that is resting on shaky grounds but that the legal consequences are severe unjust and life altering for the innocently railroaded parents or others who are accused of infanticide.
But there is a third victim not only the either severely damaged infant nor the supposed perpetrators but thirdly the MD who supposedly has missed the diagnosis of this non existent entity which is nowadays called non accidental trauma as well as by dozen other names.
The College of Physicians and Surgeons of Ontario is busy harrassing to death or practice abandonment or license withdrawal of MDs who have been unfortunate enough to be involved in a so called shaken baby syndrome which they have failed to report.
The MDs who were involved in assessing my case were evidently incapable of comprehending my research which was short on the expected false verities and long on a diachronic apercue of the issues involved.
So I am to be subjected to investigation as an incompetent physician both mentally and physically because one of the female physicians of the panel adjudged me after a few minutes of kanguroo court proceedings as such. She must belong to the cult of the true believers of the SBS. I have acceded to her demand that I cease to see paediatric patients immediately but evidently one pound of flesh wasnt enough she wants a second and a third as well. She wants all three hundred pounds of me.
Dr. Jablanczy, my sincerest condolences to you as you too are a victim of these injustices. We hear much of the tragic injuries to these infants and the injustices done to innocent parents and caregivers when the justice system fails, but near silent it has been to physicians who have not followed the mainstream diagnosis of SBS. Have you considered going public about what is occurring in your case or is their a publicity ban on these cases as it is in family court issues? Once complete are you able to disclose some of the details of your case in an effort to bring awareness to this problem? Wishing you all the best and keep us updated as to the outcome.
We are currently going through an unimaginably horrible nightmare due to this shaky science. Even though our son had seizures 5 weeks after a precipitous birth with the umbilical cord wrapped around his head, he had drastic head circumference fluctuations in the first couple of weeks, we reported dazed looks, high-pitched screams during multiple visits to the pediatrician in the first 2 weeks, he was Vitamin D deficient, he is developmentally advanced and has no issues, we have a 3 year old healthy, happy daughter with no health concerns, we have no substance abuse/mental health issues, we have testimonies from our pediatrician to neighbors, colleagues and school teachers that we are devoted parents AND we have diagnoses of benign external hydrocephalous and rickets from top-notch doctors. They just dismiss it all and say SBS!
Please, please help!!
